Festival Terms

Harlem EatUp! is produced by KACMSG LLC (referred to below as “Festival Organizers”).

TICKETS

Tickets are available for purchase via the Festival website, www.HarlemEatUp.com. The Festival requires purchasing tickets in advance. Citi is the Preferred Card of Harlem EatUp!

Tickets for the Dine In Harlem dinner series must be purchased in advance. No onsite tickets will be available for sale at the dinners.

Tickets for The Stroll will be available for sale at the Harlem EatUp! Mobile Box Office, immediately prior to the start of the event. Please check the FAQ section of HarlemEatUp.com for more information on the Mobile Box Office location. Ticket availability at the door is not guaranteed and will be sold on a first-come, first-serve basis. Payments must be made by credit card or cash.  No checks will be accepted.

All events, prices, personalities, performances, venues, dates and times are subject to change without notice. All sales are final. No refunds, exchanges or replacements. Tickets for Harlem EatUp! are not tax deductible.

AGE RESTRICTIONS

No one under the age of 21, including children in strollers accompanied by their parents, will be admitted to Festival events, with the exception of the family-friendly areas at the following events at Morningside Park – The Marketplace at The Stroll on both Saturday, May 19 and Sunday, May 20. Please be prepared to show valid government-issued photo identification such as a driver’s license or passport for proof of age at all events.

INDIVIDUALS UNDER THE AGE OF 21

As a responsible member of the community, Festival Organizers abide by and adhere to all New York City Laws governing the consumption of alcoholic beverages. Therefore, in accordance with the State Liquor Authority of New York, no one under the age of 21 is allowed to taste, consume, or possess alcohol products at this event.

INCLEMENT WEATHER

Festival Organizers accept no responsibility, financial or otherwise, for event cancellation or interruption because of inclement weather or other acts beyond its control. The Festival does not refund for cancellation due to inclement weather or other acts beyond its control.

LIMITATION OF LIABILITY

KACMSG LLC, their affiliates, divisions, sponsors, advertising agencies, owners, partners, officers, directors, independent contractors, employees, agents contractors, representatives, successors and assigns assume no responsibility and shall have no liability whatsoever (including for negligence) for any bodily injury, damage to or loss of ticket holder’s (“Holder”) person (including, without limitation, wrongful death) or property in connection with this event or in the future while on the premises.

Holder releases liability and voluntarily assumes all risks and dangers incidental to the event for which the ticket is issued (“Event”), whether occurring prior to, during, or after the Event. Holder voluntarily agrees that the Festival, Partners, Venues, Producers and their respective officers, directors, owners, affiliates, employees and agents acting by and through them, are expressly released by Holder from any claim incidental to the Event.

RIGHT TO USE YOUR NAME, VOICE, IMAGE AND LIKENESS

By using this event ticket, Holder grants Festival Organizers, sponsors, affiliates and licensees the irrevocable, transferable, perpetual right and license to publish, print, display, record and use (by photograph, film, tape, oral devices and any other method or device) the Holder’s name, voice, image and likeness while at the Festival (the “Recordings”), and use such of the Recordings for any and all purposes, in any and all media now known or hereafter devised.

Holder also acknowledges that the recording of any of the events during the Event is strictly prohibited.

BAG CHECK

Festival Organizers reserve the right to check all bags at the entrance of all events. Prohibited items include, but are not limited to: Outside food and beverages, drugs, weapons, backpacks, large bags, and suitcases.

RESPONSIBLE CONSUMPTION OF PRODUCTS

As responsible members of the community, the Festival Organizers encourage responsible consumption of alcohol during the Festival, especially as it relates to drinking and driving. If Holder believes that his/her driving ability may be impaired or that Holder cannot safely operate a motor vehicle, please speak with a Festival representative who will arrange for transportation back to Holder’s destination point.

NO CONTAINERS OF ANY ALCOHOLIC BEVERAGE, OPENED OR UNOPENED, MAY BE BROUGHT ON TO OR REMOVED FROM THIS SITE FOR ANY REASON.
